The claims process through the Equal Employment Opportunity Commission and the civil litigation process from the state level through the Supreme Court are claims that are pursued everyday by people. Complaints filed through the Equal Employment Opportunity Commission are complaints that people feel their employer has discriminated against them in some way. Civil litigation is a suit being filed by a person against another person, or a company against a person, or vise versa. ... There are several steps in processing a complaint through the EEOC. ... At this time the counselor will provide information to the individual making the complaint on how the EEO process works, and give the individual in writing their rights and responsibilities in the EEO process. ... Secondly comes the complaints and dismissal of complaint process. ... The complaint is usually a signed statement from the individual making the complaint, containing the individual’s telephone number and address, the agency the individual is making the complaint against, and describing the action which brought upon the complaint. Prior to a request for hearing, an agency may dismiss an entire complaint for several reasons: 1) failure to state a claim, or stating the same claim that has been decided by the agency or EEOC; 2) failure to comply with the time limits; 3) filing a complaint that has not been brought to the attention of an EEO counselor.
