Dellree Mapp
In 1961, Dellree Mapp was convicted in a state court of possessing pornographic material in violation of Ohio law. Her conviction was obtained on the basis of evidence taken by the police when they entered her boarding house during 1957 without a search warrant while looking for gambling materials. The question presented in this case is that were the confiscated materials protected by the first amendment? May evidence obtained through a search in violation of the fourth amendment be admitted in a state criminal proceeding? In today’s opinion that was obviously a violation of the civil rights of the United States of America.
