Divorce is the legal termination of a marriage resulting because of marital misconduct occurring after the wedding ceremony. “No fault” divorce is when the spouse that is suing for divorce does not need to prove that the other spouse did anything wrong when filing for divorce. In order to file for a “no fault” divorce, the spouse must state the reason for which he/she wants a divorce. Reasons such as “incompatibility”, “irreconcilable differences”, and “irremediable breakdown of marriage” can be used. Canada’s current divorce law was amended on July 1, 1986. This act sets the standards for divorce, child support and the custody of children during and after the divorce.
